SPURSPLAY PREMIUM SUBSCRIPTION TERMS AND CONDITIONS

1. THESE TERMS AND CONDITIONS

1.1 What these terms cover. These are the terms and conditions that apply to your use of SPURSPLAY Premium, a media subscription service that makes certain content (subject to Premier League permissions) including pre-season friendlies, Under-18s, Under-21s and select Women's matches, documentaries, commentary and match replays ("SPURSPLAY Premium Content") available to you. SPURSPLAY Premium Content is made available by us on the official Tottenham Hotspur website ("Website") and via the Spurs official app ("Spurs App").

1.2 Why you should read them. You must agree to and accept all of these terms and conditions or you do not have the right to use SPURSPLAY Premium Content. Please read these terms and conditions carefully as they provide important information regarding who we are, how we will provide SPURSPLAY Premium Content to you, how subscriptions agreements are entered into and what to do if there is a problem. If you have any questions regarding these Terms and Conditions, please follow the process as outlined in clause 11.

1.3 Further applicable terms. If SPURSPLAY Premium Content is accessed via our Website, the Website Terms and Conditions and Privacy Policy (accessed at https://www.tottenhamhotspur.com/information/privacy-policy/) shall also apply. Where these terms and conditions are inconsistent with the Website Terms of Use, these terms and conditions shall take precedence. If SPURSPLAY Premium Content is accessed via our Spurs App, the Spurs App Terms and Conditions and Privacy Policy (accessed at https://www.tottenhamhotspur.com/information/privacy-policy/) shall also apply. Where these terms and conditions are inconsistent with the Spurs App Terms of Use, these terms and conditions shall take precedence.

1.4 By accessing SPURSPLAY Premium Content you agree to these terms and conditions. Your use of SPURSPLAY Premium Content means that you agree to all of these terms and conditions (as well as further applicable terms referred to in section 3), just as if you had agreed to these terms and conditions in writing.

1.5 Changes to these terms and conditions. You understand and agree that we may review these terms and conditions and make changes at any time. Any such changes are effective immediately and your continued use of SPURSPLAY Premium Content shall constitute on-going acceptance of these terms and conditions, as updated from time-to-time. We therefore recommend that you check these pages regularly.

2. INFORMATION ABOUT US

2.1 Who we are. We are Tottenham Hotspur Limited, a company registered in England and Wales (referred to in these terms and conditions as the "Club", "we" or "us" and "our" should be interpreted accordingly). Our company registration number is 1706358 and our registered office is at Bill Nicholson Way, 748 High Road, Tottenham, London, N17 0AP.

3. ACCESSING SPURSPLAY PREMIUM CONTENT AND YOUR CONTRACT WITH US

3.1 Accessing SPURSPLAY Premium Content. SPURSPLAY Premium Content can be accessed via the Website or via the Spurs App. In order to access SPURSPLAY Premium Content, you must have a valid paid subscription to SPURSPLAY Premium Content or otherwise be granted access to SPURSPLAY Premium Content by the Club. In order to access via the Spurs App, you will need to have the Spurs App downloaded from the relevant application store on your device. The Spurs App is free of charge and we reserve the right to change this at any time.

3.2 Purchasing access to SPURSPLAY Premium Content. Access to SPURSPLAY Premium Content may be purchased via the Website by clicking on the 'purchase' button, which will provide you with access for the time period selected by you ("Subscription Period"), and then following the prompts that will appear on-screen. You must be over 18 (eighteen) to purchase access to the SPURSPLAY Premium content and you may check and correct any input errors in your purchase up until the point at which you submit your purchase request to us by clicking the "Submit Payment" button on the checkout page.

3.3 How we will accept your order. You acknowledge that by clicking on the "Submit Payment" button you are offering to enter into an obligation to pay for SPURSPLAY Premium Content ("Subscription") and, once accepted by us, a contract will be formed between you and us in relation to the Subscription ordered. If we are unable to provide a Subscription to you for any reason, then we will inform you of this and you will not be charged any fees. Once a Subscription offer is accepted by us, SPURSPLAY Premium Content will become available to you straight away (however please allow up to 15 minutes for access, and we encourage you to subscribe well in advance of a particular live broadcast) and will remain available throughout the term of your Subscription until cancelled, subject to these terms and conditions.

3.4 Subscription fee. When you purchase a Subscription, you will be charged the fee displayed on the checkout page ("Subscription Fee"), which will be charged to you in advance and in accordance with section 4 below. The Subscription Fee will be notified to you when you sign up and we reserve the right to adjust pricing at any time. Any adjustment to the Subscription Fee will not apply to your current Subscription Period, and if you are not happy with the increase in the Subscription Fee you may cancel your subscription in accordance with clause 6. The Subscription Fee is inclusive of VAT.

3.5 Subscription renewal. Your subscription will automatically renew for consecutive Subscription Periods and you will be charged the Subscription Fee for each Subscription Period after that until you cancel. You may cancel your Subscription at any time (at which point your subscription will no longer automatically renew) in accordance with section 6.3 below.

3.6 Promotional offers. If we offer any promotions or special offers in relation to the Subscription, these Terms and Conditions shall be deemed to be amended to take into consideration the terms of such special offer.

4. PAYMENTS

4.1 Use of payment processor. When you purchase SPURSPLAY Premium Content, we use a third-party payment processor, Stripe (the "Payment Processor") to bill you for your Subscription Fee. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these terms and conditions. We are not responsible for error by the Payment Processor.

4.2 Charges and payment terms. By signing up for a Subscription, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for your Subscription in accordance with the applicable payment terms, and you authorise us, through the Payment Processor, to charge your chosen payment provider.

4.3 Payment method. You must provide us with a current, valid, accepted method of payment ("Payment Method"). We may update the accepted methods from time to time. You agree to make payment using the selected Payment Method. We reserve the right to correct any errors or mistakes that the Payment Processor makes even if it has already requested or received payment.

4.4 Failure to pay on time. If we, through the Payment Processor, do not receive payment from you on time, you agree to pay all amounts due by you to us upon demand. If you do not pay us charges you owe us on time (including if any correct charge to your credit or debit card is not authorised), we may suspend or terminate your access to SPURSPLAY Premium Content (and we reserve the right to pursue any available legal remedy to collect the amount owed by you). However, charges will continue to be incurred until your Subscription is cancelled.

5. OUR CONTENT AND YOUR USE OF SPURSPLAY PREMIUM CONTENT

5.1 Our content. All SPURSPLAY Premium Content, as well as our Website, (including but not limited to the web site design, photographs, images, text, graphics, audio clips, visual clips, logos, button icons and the selection and arrangement thereof) are either our property or that of our content suppliers and are protected by English and international intellectual property laws and we reserve the right to update the content, features and/or functionality at any time. In using or interacting with SPURSPLAY Premium Content and / or the Website, you will not (a) infringe or attempt to infringe the intellectual property rights or any other rights of anyone else (including the Club) or (b) download, copy or store any part of SPURSPLAY Premium Content and / or the Website. We reserve the right to make changes to the SPURSPLAY Premium Content at any time.  

5.2 Your use of SPURSPLAY Premium Content. You may only use SPURSPLAY Premium Content for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. Any other use of materials on SPURSPLAY Premium Content (including reproduction for purposes other than those noted above, modification, distribution, transmission, broadcasting republication, downloading or uploading without our prior written permission) is strictly prohibited.

5.3 Pre-Season Friendlies Streaming Availability.  Our full Men’s 2023/24 pre-season friendly schedule is listed below. The first 4 games can be streamed internationally in all locations other than the host territory. The fifth, and final game, versus FC Barcelona will only be available to stream in the UK. 

  • Spurs vs West Ham United, Tuesday 18 July, 12noon (UK time), Perth, Australia*
  • Leicester City vs Spurs, Sunday 23 July, 11am (UK time), Bangkok, Thailand*
  • Spurs vs Lion City Sailors, Wednesday 26 July, 12.30pm (UK time), Singapore*
  • Spurs vs Shakhtar Donetsk, Sunday 6 August, 2pm (UK time), Tottenham Hotspur Stadium
  • FC Barcelona vs Spurs, Tuesday 8 August, 7pm (UK time), Barcelona, Spain~

5.4 Your Subscription may not be shared with others. Your Subscription and login details are personal to you and you agree not to transfer or gift your Subscription to third parties or allow third parties to use your SPURSPLAY Premium Content account or Subscription. The SPURSPLAY Premium Content may be accessed on up to 2 devices at any one time. You are responsible for all activity that occurs under your account or Subscription, including any activity by unauthorised party. You must safeguard the confidentiality of your password, and if you are using a device that others have access to, log out of your account after using your account or Subscription. If you become aware of an unauthorised access to your account, change your password and notify the Club immediately.

5.5 Technical Requirements. In order to stream the SPURSPLAY Premium Content you will need a network/device access that meets the following technical requirements:

  • A broadband internet connection (DSL/cable or higher) of 750kbps or higher is needed for SPURSPLAY Premium Content. If you have an internet connection speed of 5.0Mbps or higher and your computer meets the requirements below, you will be able to enjoy SPURSPLAY Premium content at its highest video quality.

MINIMUM WINDOWS REQUIREMENTS

  • Pentium III 1GHz or higher or equivalent AMD processor with a minimum of 512MB of memory
  • One of the following operating systems: Windows 10, Windows 7, Windows XP, Windows Vista, or Windows Media Centre Edition, or Firefox v1.5 or above
  • IE: http://www.microsoft.com/ie
  • Firefox: http://www.mozilla.com/firefox
  • Video adapter and monitor: Super VGA (1024x768) or higher

MINIMUM MAC REQUIREMENTS

  • PowerPC G3 600 MHz

BROWSER COMPATIBILITY

  • SPURSPLAY is available on Chrome, Firefox, Safari, Edge and IE (IE11+)

The Club cannot be liable for poor quality streams if you do not meet these technical requirements and is not responsible for any costs associated with your internet connection and/or data usage.

6. YOUR RIGHT TO CANCEL

6.1 Your right to a refund. You are entitled to a full refund if you cancel your Subscription by contacting us in accordance with section 6.3 within fourteen days from the date you subscribed (“Cancellation Period”), provided that you have not accessed any SPURSPLAY Premium Content during that time. For example, if you subscribe on 1 May and have not accessed any SPURSPLAY Premium Content, you may cancel at any point up to 11.59pm on 15 May and receive a full refund. However, if you wish to access the SPURSPLAY Premium Content immediately, you will have expressly requested that at the point of purchase and the Cancellation Period will not apply. Please be aware that accessing SPURSPLAY Premium Content includes but is not limited to viewing any content or listening to any audio commentary.

6.2 Cancelling your Subscription Renewal. You may cancel your Subscription at any time in accordance with section 6.3. Following cancellation, you will continue to have access to SPURSPLAY Premium Content for the remainder of the Subscription Period and will not receive a refund for the current Subscription Period unless permitted in accordance with section 6.1.

6.3 Contacting us to cancel. You can cancel your Subscription at any time via the 'Subscriptions' page of your SPURSPLAY account (accessible by navigating to your account (human icon) after signing in at Tottenhamhotspur.com/signup) and clicking the 'Cancel' button that can be found next your active subscription. Your subscription will then cancel at the end of the current Subscription Period.

7. HOW YOUR ACCESS TO SPURSPLAY PREMIUM CONTENT MAY BE TERMINATED

7.1 We may terminate if you breach contract. We may terminate your access to SPURSPLAY Premium Content if you:

  1. breach any material or important term set out in these terms and conditions;
  2. breach these terms and conditions and do not correct the breach within seven days of us telling you to do so; and
  3. do not make any payment to us when it is due and you still do not make payment within seven days of us reminding you that payment is due.

7.2 Other circumstances where we may terminate. We may also terminate your access to SPURSPLAY Premium Content:

  1. for technical or operational reasons beyond our control;
  2. should we be required to in order to comply with applicable laws and regulatory requirements;
  3. you have paid an obviously incorrectly priced Subscription Fee (in which case we will refund you in full upon termination); or
  4. if we decide, at our discretion, to stop providing SPURSPLAY Premium Content in your country of residence.

7.3 Your refund following termination by us. Should we terminate your access to SPURSPLAY Premium Content for any reason set out in section 2, we will refund to you a proportion of any Subscription Fee that you have paid calculated on a pro rata basis by reference to the period of time for which you have paid to access SPURSPLAY Premium Content but for which you will not receive access to SPURSPLAY Premium Content.

8. OUR LIABILITY TO YOU

8.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

8.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products and for defective products under consumer protection regulations.

8.3 We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

9. HOW WE MAY USE YOUR PERSONAL INFORMATION

9.1 How we may use your personal information. We will only use your personal information as set out in our Privacy Policy.

10. OTHER IMPORTANT TERMS

10.1 Transferring your contract with us to someone else. We may transfer our rights and obligations under these terms and conditions to another organisation. You may only transfer your rights or your obligations under these terms and conditions to another person if we agree to this in writing.

10.2 Your contract is between you and us. No other person shall have any rights to enforce any of its terms.

10.3 Each paragraph and sub-paragraph of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs and sub-paragraphs will remain in full force and effect.

10.4 Even if we delay in enforcing your contract with us, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

10.5 The laws that apply to your contract with us. These terms and conditions are governed by and to be interpreted in accordance with English law and will be subject to the jurisdiction of the English courts.

12. SPURSPLAY PRE-SEASON UK PROMOTION - TERMS AND CONDITIONS (THE "PROMOTION")

12.1 The promoter is: Tottenham Hotspur Limited, a company registered in England and Wales (company number 1706358) whose registered office is at Lilywhite House, 782 High Road, Tottenham, London, N17 0BX (the “Promoter”).

12.2 The Promotion is open to anyone over the age of eighteen (18) years old.

12.3 This Promotion entitles you to £10 (Ten Pounds Sterling) off the then standard price of your use of SPURSPLAY Premium, a media subscription service that makes certain content (subject to Premier League permissions) including Tottenham Hotspur pre-season friendlies, Under-18s, Under-21s and select Women's matches, documentaries, commentary and match replays ("SPURSPLAY Premium Content") if purchased between 09.00 UK time on 3 August 2023 until 23:59 UK time on 10 August 2023 and in accordance with paragraphs 5 and/or 6.

12.4 By purchasing SPURSPLAY Premium Content using this Promotion, you agree to be bound by these terms and conditions and the SPURSPLAY Terms and Conditions (which can be found here).

12.5 To redeem the Promotion, you must purchase SPURSPLAY Premium Content through the Club’s official SPURSPLAY website (which can be found here), where the discount will be automatically applied at checkout. This discount can only be used on your first purchase and cannot be used in conjunction with other discount/promotional codes or gift cards, except only the discount provided for in paragraph 6

12.6 If you are a One Hotspur Member or a Season Ticket Holder, you may redeem your additional £10 (Ten Pounds Sterling) voucher that is specific to your One Hotspur Membership or Season Ticket to be used in conjunction with the Promotion. To redeem this discount, you must enter the promotional code provided to your email address upon purchase of your One Hotspur Membership or Season Ticket, at checkout prior to purchase. This promotional code can only be used on your first purchase and cannot be used in conjunction with any other discount/promotional codes or gift cards, except only the discount provided for in paragraph 5

12.7 By redeeming the Promotion, you confirm that you are over eighteen (18) years of age.

12.8 Subscriptions of all SPURSPLAY Premium Content purchased at the promotional price will provide you access for the standard period of twelve (12) months from the date of purchase ("Subscription Period") and will be automatically renewed at the then standard price (without the promotion applied) for consecutive Subscription Periods subject to the SPURSPLAY Terms and Conditions (which can be found here). You will be notified via the email address you subscribed with no later than two (2) weeks in advance of the auto renewal of your membership and such notice will inform you of the price and date of renewal and any instructions on how to cancel the renewal without charge. A cooling off period of fourteen (14) calendar days applies and you can cancel your subscription free of charge up to fourteen (14) days after renewal payment is taken.

12.9 The Promotion commences at 09.00 UK time on 3 August 2023 until 23.59 UK time on 10 August 2023. Once the Promotion ends at 23.59 UK time on 10 August 2023, the discount referred to in paragraph 5 above will expire and the price for subscribing to SPURSPLAY Premium Content will revert back to the then standard price (without the promotion applied).

12.10 No cash alternative will be offered to any person who wishes to use the Promotion.

12.11 The Promoter reserves the right to change, terminate, postpone or temporarily suspend the Promotion and these terms and conditions at any time, with or without giving prior notice (for example, if this is necessary due to reasons outside of the Promoter’s control (including for example if fraud or suspected fraud is identified)).

12.12 The Promoter does not accept any responsibility for: (i) any failure to apply the discount referred to in paragraph 5 above caused by you or any issues occurring during transmission or caused by an error beyond the Promoter’s reasonable control; (ii) any incorrect, inaccurate, or incomplete entries of the promotional code referred to in paragraph 6 above caused by you or any issues occurring during transmission; or (iii) entries of the promotional code referred to in paragraph 6 above not received for whatever reason, including for entries that are lost, delayed, or corrupted, or due to computer error in transit, and no such correspondence will be entered into between you and the Promoter and/or its affiliated entities.

12.13 The Promoter reserves the right to invalidate a use of the Promotion by any person who is in breach of these terms and conditions.

12.14 The Promoter is not liable for failing to meet its obligations under these terms and conditions if this is due to circumstances beyond the Promoter’s reasonable control. Such circumstances include, for example: extreme weather conditions, fire, flood, hurricane, industrial action, war, hostilities, political unrest, riot, civil commotion, national mourning, unavoidable accidents, a pandemic, or epidemic, or a change in law or regulation.

12.15 The Promoter reserves the right to hold and void, suspend, cancel or amend the Promotion at any time as it sees fit and if voided, suspended or cancelled the Promoter is under no obligation to deliver the Promotion to any person.

12.16 To the extent permitted by law, the Promoter is not liable for any loss, damage, injury, or disappointment suffered in connection with the Promotion or any delays or failure (in whole or in part) to perform any of its obligations if such delay or failure is caused by something beyond its control.

12.17 The Promoter will not be held responsible for any person not taking full advantage of the Promotion due to any reason.

12.19 The Promotion and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. SPURSPLAY PRE-SEASON BRAZIL & INDIA PROMOTION - TERMS AND CONDITIONS (THE "PROMOTION")

13.1 The promoter is: Tottenham Hotspur Limited, a company registered in England and Wales (company number 1706358) whose registered office is at Lilywhite House, 782 High Road, Tottenham, London, N17 0BX (the “Promoter”).

13.2 The Promotion is open to anyone over the age of eighteen (18) years old whose home address is in the following territories: (i) Brazil; or (ii) India.

13.3 This Promotion entitles you to purchase access to SPURSPLAY Premium, a media subscription service that makes certain content (subject to Premier League permissions) including Tottenham Hotspur pre-season friendlies, Under-18s, Under-21s and select Women's matches, documentaries, commentary and match replays ("SPURSPLAY Premium Content") for £10 (Ten Pounds Sterling) if purchased between 09.00 UK time on 4 August 2023 until 23:59 UK time on 11 August 2023 and in accordance with paragraphs 5 and/or 6.

13.4 By purchasing SPURSPLAY Premium Content using this Promotion, you agree to be bound by these terms and conditions and the SPURSPLAY Terms and Conditions (which can be found here).

13.5 To redeem the Promotion, you must purchase SPURSPLAY Premium Content through the Club’s official SPURSPLAY website (which can be found here), where the discount will be automatically applied at checkout. This discount can only be used on your first purchase and cannot be used in conjunction with other discount/promotional codes or gift cards, except only the discount provided for in paragraph 6

13.6 If you are a One Hotspur Connect member, you may redeem your £10 (Ten Pounds Sterling) SPURSPLAY voucher that is specific to your One Hotspur Connect membership to be used in conjunction with the Promotion. To redeem this voucher, you must enter the promotional code provided to your email address upon purchase of your One Hotspur Connect membership, at checkout prior to purchase. This promotional code can only be used on your first purchase and cannot be used in conjunction with any other discount/promotional codes or gift cards, except only the discount provided for in paragraph 5

13.7 By redeeming the Promotion, you confirm that you are over eighteen (18) years of age.

13.8 Subscriptions of all SPURSPLAY Premium Content purchased at the promotional price will provide you access for the standard period of twelve (12) months from the date of purchase ("Subscription Period") and will be automatically renewed at the then standard price (without the promotion applied) for consecutive Subscription Periods subject to the SPURSPLAY Terms and Conditions (which can be found here). 13.11 The Promoter reserves the right to change, terminate, postpone or temporarily suspend the Promotion and these terms and conditions at any time, with or without giving prior notice (for example, if this is necessary due to reasons outside of the Promoter’s control (including for example if fraud or suspected fraud is identified)).

13.12 The Promoter does not accept any responsibility for: (i) any failure to apply the discount referred to in paragraph 5 above caused by you or any issues occurring during transmission or caused by an error beyond the Promoter’s reasonable control; (ii) any incorrect, inaccurate, or incomplete entries of the promotional code referred to in paragraph 6 above caused by you or any issues occurring during transmission; or (iii) entries of the promotional code referred to in paragraph 6 above not received for whatever reason, including for entries that are lost, delayed, or corrupted, or due to computer error in transit, and no such correspondence will be entered into between you and the Promoter and/or its affiliated entities.

13.13 The Promoter reserves the right to invalidate a use of the Promotion by any person who is in breach of these terms and conditions.

13.14 The Promoter is not liable for failing to meet its obligations under these terms and conditions if this is due to circumstances beyond the Promoter’s reasonable control.
