The incident arrived just after Villa had opened the scoring the second half.
Striker Jermain Defoe collected a low cross from Fredi Kanoute, looked to turn but was clearly brought down by J-Lloyd Samuel.
Unfortunately, referee Chris Foy didn't see any contact and actually penalised Jermain for handball after the striker landed on the ball.
Head Coach Martin sighed: "I was on the bench maybe 80 yards away but I thought it was a penalty.
"He was not kicking him but he was stamping on his foot, the referee was closer than we were and he did not give it so that was a bit unfortunate."
Martin Jol was convinced he saw a penalty at Villa Park last night - television replays backed up his claim.
